this Privacy Policy to set-forth exactly what we mean when we say your
information will be kept private.

personally identifiable information reasonably necessary or related to our
efforts to respond to your requests for our products and services. Depending
on the services you request, this information may include, but is not
limited to, your name, address, zip code, e-mail address, telephone number,
and whether you plan on buying or selling property, or both, information
about the properties in which you are interested and the criteria you
provide in relation to these activities.
You will be asked to provide personally identifiable information at
various places in our web site, including, but not limited to, the

Asking us to provide you information or contact you: If you wish us to
contact you, we collect information including your first and last name,
address, zip code, telephone number, email address, preferred method of
contact, best time to contact you, as well as information about your
motivation and goals in wishing to communicate with us.
Newsletter: If you wish to subscribe to Whitcombe & Co.'s Market
Trends Newsletter, we will collect your first and last name, address, zip
code, telephone number, email address.
Property Value Estimates: If you wish for us to provide an estimated
listing price for you property, or to estimate the fair market value of a
home you are interested in, we will collect information reasonably necessary
to provide the requested service.
Information collected in the course of representation: If you choose to
interact with Whitcombe & Co. or one of our agents, we may collect
information in the course of providing our goods and services. Because
providing real estate brokerage and legal services is a complex and involved
task, this information may include a wide variety of personal information,
including but not limited to, your name, address, zip code, e-mail address,
telephone number, social security number, credit history reports,
information about your property, including liens and property
characteristics, your history of litigation, and whether you plan on buying
or selling property, or both, information about the properties in which you
are interested and the criteria you provide in relation to these activities.
2. What general information is collected and how it is used:
Apart for the information listed is section "1," above, we do
not collect any other general information. We do not use cookies.
3. With whom personally identifiable information is shared:
Your personal information is maintained by Whitcombe & Co. in order
to fulfill our legal and regulatory requirements and to provide you with the
information, products and services you have requested. As a general rule,
Whitcombe & Co. will not disclose your personal information to any third
party except with your permission or under special circumstances, as
discussed below.
Whitcombe & Co. will disclose to interested parties information
pertaining to the sale of a house listed with us. This information will be
posted on our web site and in the local Multiple Listing Service (MLS).
By requesting information or services from Whitcombe & Co., you give
us permission to transfer your information, as reasonably necessary, certain
persons and entities, such as the title insurer, lender, appraiser, escrow
or settlement provider or inspector participating in your transaction(s), so
that they can fulfill your request and provide you with goods and/or
services.
Your information may also be transmitted to other parties in a
transaction or their agent. Our Agents are independent contractors licensed
by the California Department of Real Estate, with contracts to perform
services for Whitcombe & Co. All personally identifiable information you
provide to Whitcombe & Co. will be made available to your Agent and
other Whitcombe & Co. employees that reasonably require the information
to perform their designated duties.
Generally, your Agent oversee the disclosure of your information to third
parties, in accordance with the customs and practices of persons engaged in
the real estate industry. The various lending institutions, title companies
and other service providers involved in your real estate transaction may
each have their own privacy policies governing how they handle your
personally identifiable information. Whitcombe & Co. is not responsible
or liable for third party privacy policies or the actions of any third party
with respect to your personally identifiable information.
Whitcombe & Co. will not sell or lease personally identifying
information to any third-party, provided however, that in the event that
Whitcombe & Co. refers you to another real estate agent, attorney, or
real estate broker, or to a lending-related entity, title insurance company,
escrow company, or other real estate-related good or service provider,
Whitcombe & Co. may provide information to such entities as is
reasonably necessary to competently provide service to you.
If you came to our website through a link on another website
("Third-Party Website"), Whitcombe & Co. may be
required, as part of our agreement with that Third-Party Website, to provide
them with aggregated data or some personally identifiable information.
Whitcombe & Co reserves the right to disclose your personally

If you wish Whitcombe & Co. to refrain from contacting you, or for
Whitcombe & Co. to delete all of your personally identifiable
information from their databases and files, or from Whitcombe & Co. to
return any documents in their possession related to their representation of
you, Whitcombe & Co. will comply with any request that we take such
action, subject to legal and regulatory provisions that require Whitcombe
& Co. to maintain certain records regarding our representation of real
estate clients.
You are free to refuse to provide any of the information requested on the
Whitcombe & Co. web site. However, if you choose not to provide the
requested information, we may not be able to provide you with certain

We restrict access to Whitcombe & Co. computers and the personal
information we store there by using a log-in process. Documents containing
your personal information are maintained in our office, and are made accessible
only to authorized persons.
Unfortunately, no e-mail transmission over the Internet is absolutely
secure. Whitcombe & Co. cannot guarantee the security of any information
you transmit to us from our website, and you do so at your own risk. Once we
receive your transmission, we take reasonable measures to ensure its
security on our system. Finally, we store all data on our system in a
password protected database system, which is protected by a firewall.
